Richard Wayne Nyte Jr., 40, of Guthrie Was arrested after the fatality accident on Highway 33 on Wednesday for driving under the influence. Thursday afternoon, Nyte Jr. was in front of Judge Louis Duel charged with felony manslaughter in the first degree (DUI/ automobile) or in the alternative felony manslaughter in the first degree (driving a motor vehicle left of center) Nyte Jr. is being held on a $50,000 bond and is due back in court on Friday May 14 at 1:30 p.m. for his arraignment. If convicted the minimum sentence is four years in jail.
